The primary law governing drunk driving in Michigan is MCL 257.625. This statute defines the various levels of intoxication, impairment, and the corresponding penalties. Key Provisions of Sec. 625

A person shall not operate a vehicle upon a highway or other place open to the public if they are under the influence of alcohol/controlled substances, or have a BAC of 0.08 grams or more (or 0.17 grams for "Super Drunk" charges).

Prohibits operation when, due to consumption of alcohol or drugs, the person's ability to operate the vehicle is visibly impaired. This is often a lesser charge than OWI.

Violations causing death are felonies punishable by up to 15-20 years. Violations causing serious impairment of a body function are felonies punishable by up to 5 years.

Persons under 21 are prohibited from operating a vehicle with any bodily alcohol content (defined as 0.02g to 0.08g).
