Michigan Support Statutes
MCLA 750.161: Desertion & Abandonment
Applies to individuals who desert or abandon a spouse or children under 17 without providing necessary shelter, food, and care. This is a continuing offense.
Penalty: Felony punishable by 1 to 3 years in state prison or up to 1 year in county jail.
MCLA 750.165: Refusal to Support (Court Order)
If a court orders support and the individual fails to pay at the time or in the amount stated, they may be charged with a felony.
Penalty: Felony punishable by up to 4 years in prison and/or a $2,000 fine.
Bond, Probation, and Amnesty
Michigan law allows for the suspension of sentences if a defendant enters into a bond conditioned on future compliance with support orders. Additionally, under MCLA 750.161a, individuals may be protected from prosecution if they have been granted amnesty for arrearages through the Office of Child Support.
