Michigan Kidnapping Statutes

MCLA 750.349: Kidnapping

Knowingly restraining another person with intent to hold for ransom, use as a hostage, or take them out of state.

Penalty: Felony punishable by Life in Prison or any term of years, and up to a $50,000 fine.

MCLA 750.349b: Unlawful Imprisonment

Knowingly restraining a person by means of a weapon, secret confinement, or to facilitate another felony.

Penalty: Felony punishable by up to 15 years in prison and a $20,000 fine.

MCLA 750.350a: Parental Kidnapping

A parent taking or retaining a child for more than 24 hours with intent to conceal them from another parent with legal custody. This is a felony punishable by up to 1 year and 1 day in prison.

Understanding "Restraint"

Under Michigan law, to restrain means to restrict a person's movements or confine them so as to interfere with their liberty without consent. Crucially, the restraint does not have to exist for any particular length of time to be charged as a crime.
