Michigan Larceny & Retail Fraud Laws

MCLA 750.356: General Larceny

Stealing money, goods, or property of another. Penalties are based on value:

  • $20,000 or more: Felony, up to 10 years in prison.
  • $1,000 – $20,000: Felony, up to 5 years in prison.
  • $200 – $1,000: Misdemeanor, up to 1 year in jail.
  • Under $200: Misdemeanor, up to 93 days in jail.

MCLA 750.356c & 356d: Retail Fraud

Commonly known as shoplifting or price-tag switching. Includes 1st, 2nd, and 3rd-degree offenses.

1st Degree: Felony punishable by up to 5 years in prison (Value over $1,000 or prior convictions).

Specialized Larceny Charges

Michigan law includes specific statutes for Larceny from a Person (10-year felony), Larceny from a Motor Vehicle, and Larceny by Conversion.
