NSF Penalties & Thresholds
Under $100.00
First offense is a 93-day misdemeanor. Subsequent offenses can be enhanced to 1-year misdemeanors.
$100.00 to $500.00
Punishable by up to 1 year in jail or a fine of 3 times the check amount. Third offenses are Felonies.
$500.00 or More
Automatically a Felony punishable by up to 2 years in prison and significant fines.
No Account (750.131a)
Writing a check on a non-existent account or writing 3+ NSF checks within 10 days is a Felony.
The "Intent to Defraud" Defense
One of the most critical elements of an NSF charge is the intent to defraud. Michigan law (MCLA 750.132) creates a "prima facie" evidence of intent if the check isn't paid within 5 days of receiving a notice of protest. However, there are many valid defenses, including:
- Lack of knowledge regarding insufficient funds.
- Funds were unavailable due to garnishment or bank error unknown to you.
- The check was post-dated or the recipient agreed to hold it.
