Michigan Stolen Property Laws

MCLA 750.535: General Stolen Property

Penalties are determined by the total value of the property involved:

  • $20,000 or more: Felony, up to 10 years in prison.
  • $1,000 – $20,000: Felony, up to 5 years in prison.
  • $200 – $1,000: Misdemeanor, up to 1 year in jail.
  • Under $200: Misdemeanor, up to 93 days in jail.

MCLA 750.535(7): Stolen Motor Vehicles

Possessing or concealing a stolen motor vehicle is an automatic 5-year felony, regardless of the vehicle's specific dollar value.

Chop Shops & Firearms

Chop Shops (750.535a): Operating or aiding a chop shop is a 10-year felony. Stolen Firearms (750.535b): Receiving or concealing a stolen firearm is a 10-year felony.

Challenging "Knowledge" and Intent

The critical element in these cases is whether you knew or had reason to believe the property was stolen. The law often creates a "rebuttable presumption" against dealers or collectors who fail to make reasonable inquiries. Our attorneys meticulously examine the circumstances of the transaction to challenge the prosecution's claim of criminal knowledge and intent.
