Child Support Law in Michigan
Child support is calculated according to the Michigan Child Support Guidelines, which are periodically updated to reflect economic changes. The last update was in 2017.
The guidelines use a formula considering multiple factors, including:
- Income of the noncustodial parent
- Income of the custodial parent
- Number of children
- Number of overnights each parent has with the children
- Daycare expenses
The court may also consider a parent's ability to work, especially if one parent is intentionally unemployed or underemployed to affect support calculations.
Child support can be modified if there is a significant change in circumstances. Income of a new spouse is not considered in support calculations.
Typically, child support for two children is about 30% of the paying parent's net income, adjusted for daycare and other factors.
To modify support, a motion must be filed with the Circuit Court or Friend of the Court, stating the changed circumstances.
Attorney fees for modification typically range from $500 to $1,000.
