Standard First Offense Penalties
Operating While Intoxicated (OWI)
- Up to 93 days in jail
- $100 – $500 fine plus costs
- Up to 360 hours community service
- 180-day license suspension (Restricted after 30 days)
- 6 points on driving record
Operating While Impaired (OWVI)
- Up to 93 days in jail
- Up to $300 fine plus costs
- Up to 360 hours community service
- 90-day license restriction (Immediate)
- 4 points on driving record
Repeat & Serious Offenses
Second Offense (Within 7 Years)
Includes 5 days to 1 year in jail, $200–$1,000 fine, and mandatory license revocation for a minimum of one year. Vehicle immobilization or forfeiture is also possible.
Third Offense (Lifetime Felony)
Punishable by 1 to 5 years in prison, fines up to $5,000, and license revocation for a minimum of five years. This is a permanent felony record.
DUI Causing Death or Injury
Death: Up to 15 years imprisonment. Serious Injury: Up to 5 years imprisonment. These are high-level felonies with mandatory license revocation.
Zero Tolerance (Under Age 21)
Michigan enforces a "Zero Tolerance" policy for drivers under 21. Any detectable blood alcohol content can lead to a 30-day license restriction, community service, and significant fines. Subsequent offenses can lead to jail time and full license revocation.
