DIVORCE POST JUDGMENT MOTIONS

After a divorce judgment is entered, you think that you should be all done. Unfortunately, there are trips to the court house and disputes after the judgment enters. These are called post judgment motions. Post judgment motions can take many forms.

  1. Child Support can be modified whenever there is a change in circumstances. Changes in income, overnights, or any other factor effecting child support.
  2. Parenting Time can be modified anytime there is a change in circumstances. This can result in an increase in parenting time or a decrease in parenting time.
  3. Child Custody is subject to change until the child is 18 or graduates from high school. If there is a change in circumstances the court will change custody from one parent to the other.
  4. Judgment enforcement is another reason why there is a return to court. A court order directs people what to do. Unfortunately sometimes people do not follow court orders and need to be show cause why thy should not be held in contempt.
